The terms and conditions for many generative AI tools place the risk of copyright infringement on the user... In addition, game developers may not own IP in generative AI outputs – many jurisdictions (including the US) do not provide copyright protection for AI generated maters, and the terms and conditions of some free generative AI tools provide for the AI developer to retain any IP in outputs. This means that incorporating AI content into a final published game may make it more challenging to protect a game developer’s IP.
